The federal prosecutor’s office in Manhattan inadvertently revealed an internal memo criticizing the Trump administration’s approach to ending New York’s toll on driving in Manhattan. The memo, meant for a US Department of Transportation attorney, highlighted the legal risks of defending the decision to revoke federal approval for the toll. It suggested an alternative bureaucratic strategy to align with the federal government’s agenda. Despite asserting the filing as an honest mistake, the Transportation Department removed the Southern District attorneys from the case, questioning their competence.

This incident follows the resignation of top prosecutors who condemned their bosses in Washington for handling a corruption case against New York City Mayor Eric Adams unethically. Jay Clayton, Trump’s nominee, assumed interim leadership of the office amidst the controversy. Trump, a vocal opponent of the toll program, ordered its closure, citing it as detrimental to working-class Americans. New York promptly filed a lawsuit to maintain the toll, emphasizing its importance in reducing traffic and funding public transportation.

The toll, ranging from $2.25 to $9 depending on the vehicle and time, has faced opposition from suburban commuters due to additional costs on top of existing tolls. New York officials believe the program will enhance transportation infrastructure and generate substantial revenue. Despite the administration’s pressure to halt the toll, New York remains steadfast in defending the initiative.
